Statement of Terms and Conditions 

This Agreement describes the Terms and Conditions which apply to your use of NAPP™ and PainterConnection.com websites and related services. Please read the Terms and Conditions carefully, because by using this website you are acknowledging and agreeing to the terms of this Statement, without further qualification or limitation. You further agree that you are 18 years old or older, are capable of entering into this Agreement, and any information you submit to us is accurate and complete.  If you do not agree with these terms, you will not be eligible to use or request our services.

Our Service 

National Alliance of Professional Painters™, Inc. (NAPP.) provides general business training materials and related services to contractors. NAPP is not a trade association, and as such, does not publish any industry operating standards.

Further, NAPP does not endorse or recommend any contractor to perform work for the general public. Consumers are encouraged to conduct thorough trade reference and other due diligence prior to hiring any contractor.

General Disclaimer: You acknowledge and agree that NATIONAL ALLIANCE OF PROFESSIONAL PAINTERS, INC. does not guarantee that any Contractor has the necessary licenses and insurance coverage’s at the time you enter into an agreement with the Contractor, nor do we make any representation or guarantee as to the adequacy of any insurance coverage and type relating to the services you contract for with Contractor. 

We make no guarantees or representations regarding the trade skills or quality of work performed by Contractors. You enter into a contract directly with Contractor, and you acknowledge and agree that we do not guarantee or warrant their performance in any way.

No Duty 

You acknowledge and agree that National Alliance of Professional Painters, Inc. is not acting as an advisor or agent for any Member Contractor. Therefore, it is your sole responsibility to perform your own evaluation of each Member Contractor, select a Member Contractor you deem suitable, and negotiate the amounts, terms and specifications of the services performed by the Member Contractor you choose. 

Disclaimer of All Warranties 

You acknowledge that National Alliance of Professional Painters, Inc. does not have control over Member Contractors. As such, we make no warranty, expressed or implied, that Member Contractors possess the skills you require to complete your service request, will complete your project to your satisfaction, or warrant or guarantee any other result or outcome you obtain from using a member Contractor. You agree not to hold National Alliance of Professional Painters, Inc. responsible for any liabilities or claims whatsoever, relating to you and your Member Contractor.   

You agree that any disputes will be handled by and between you and your Member Contractor; therefore you release National Alliance of Professional Painters, Inc., its officers, directors, employees, and agents from any claims, demands or damages (actual and consequential) whatsoever, arising from such disputes. 

Hold Harmless.   

You agree to indemnify National Alliance of Professional Painters, Inc., its subsidiaries, employees, directors, officers, agents and area coordinators and hold each harmless from, any loss, claims or liability whatever, including reasonable attorney’s fees, and all court costs, expert witness fees, and litigation expenses made by you or any third party due to or arising from your use of this website, or with any contractor that has subscribed to the National Alliance of Professional Painters, Inc. services.  

Changes to the Service or Terms  

National Alliance of Professional Painters, Inc., may from time to time, in its sole discretion, and without notice change, add, or discontinue use of our service or change the terms of this Agreement. 

Disputes  

You agree that, unless otherwise prohibited by law, all disputes, claims, or causes of action, in law or equity, arising from or relating to this Agreement or its enforcement, performance, breach, or interpretation shall be resolved solely and exclusively by confidential final and binding arbitration in Larimer County, Colorado. Any such controversy or claim shall be arbitrated on an individual basis and shall not be consolidated in any arbitration with any claim or controversy of any other party. Judgment on the arbitration award may be entered into any court having jurisdiction thereof. You agree that any claim or cause of action arising out of or related to use of National Alliance of Professional Painters, Inc services or the Terms and Conditions must be filed within one (1) year after such claim or cause of action arose or be forever barred. 

Entire Agreement.  

Both parties acknowledge and agree that there are no representations, promises, warranties, covenants, or understandings other than those set forth herein.
